Steven Slate Rent-to-Own Payment Policy

1. Intro

PLEASE BE AWARE THAT THERE ARE CLASS ACTION PROVISIONS WITHIN THIS POLICY

The Steven Slate Audio (“SSA”) Rent-to-Own (RTO) policy (“Policy”) governs the terms and conditions under which you (“you”, “your”, or “Customer”) may purchase products sold by Yellow Matter Entertainment LLC and its affiliates with an option to purchase. By enrolling in the RTO program, you agree to comply with all obligations as set forth within this Policy. The RTO program allows you to make an initial down payment followed by monthly installment payments until the full purchase price for such product is satisfied. Failure to adhere to the payment schedule within this RTO may result in the revocation of product access and forfeiture of previously made payments.

2. Purchase and Enrollment

Where an RTO option is offered for any SSA products such option will be displayed at the time of purchase or checkout. For Customer to be eligible for the RTO program, Customer must fully make the initial down payment required and properly enroll in the RTO program. SSA is not responsible for Customer’s failure to properly enroll in the RTO program and SSA reserves the right to deny enrollment to any Customer at its discretion. Once the down payment is confirmed and received by SSA, the rented product is shipped or made available for use. If the down payment is not received or your enrollment is otherwise rejected, no product shall be provided or made available for shipping. Customer shall receive an invoice confirming the down payment and enrollment in the RTO program upon acceptance by SSA.

3. Monthly Payments

The remainder balance owed for any SSA product shall be charged in monthly installments. Monthly installment payments are automatically charged on the same date of each subsequent month as the initial down payment. The monthly installment amount varies depending on the total purchase price and down payment made. Please be aware that your monthly payments may vary due to the calculation of the total purchase price of the product purchased, we reserve the right to reconcile any amounts owed to any monthly installment payment at our discretion. All such information shall be set forth within the invoice sent to Customer at the time of enrollment. UPON YOUR ENROLLMENT IN THE RTO PROGRAM YOU AGREE THAT SSA MAY CHARGE YOU AUTOMATICALLY AND ON A RECURRING BASIS UNTIL THE FULL AMOUNT OF THE BALANCE FOR THE PRODUCT HAS BEEN PAID. ADDITIONALLY, YOU AUTHORIZE US TO BILL YOU ON A RECURRING BASIS AND YOU AGREE THAT NO ADDITIONAL CONSENT IS REQUIRED BY YOU TO CHARGE YOUR PREFERRED PAYMENT METHOD ON FILE FOR EACH SUBSEQUENT PAYMENT.

4. Default or Late Payment

In the event of a late payment or default under the RTO program, SSA reserves the right to suspend or terminate the Customer’s participation in the RTO Program and may also suspend or terminate Customers account with SSA. Customer may lose access to, usage of, or functionality of the product where Customer fails to pay in a timely manner. SSA is not responsible for any consequences arising from the Customer’s late payment or default and may, at its sole discretion, decline to offer any grace period or reinstatement of the RTO program. Upon default Customer may be required to return any products rented. Any issues related to default payments or late payments may be submitted to SSA Support.

5. Early Payoff

The Customer may choose to pay off the remaining balance of the product as stated within the invoice at any time without incurring any penalties or additional fees. Early payoff will result in the immediate transfer of ownership to the Customer, provided all other terms of this Policy have been met. To request an early payoff and receive the remaining balance amount, Customer must contact SSA Support.

6. Ownership

Until the Customer has completed all required payments and paid the balance in full for any product under the RTO program, SSA retains full ownership and title to such product. The Customer is granted only a temporary, conditional right to use the product in accordance with the terms of the RTO program. The Customer shall not sell, transfer, sublicense, or otherwise encumber the product during the RTO period. Ownership of the product will transfer to the Customer only upon full completion of all payments and compliance with the terms of this Policy. Failure to complete payments may result in the loss of access and the required return of the product.

7. Return Policy

If the Customer is required to return the product under the terms of the RTO, the Customer is responsible for all shipping costs associated with the return. Before returning the product, the Customer must first contact SSA Support to obtain return authorization and further instructions. Unauthorized returns may not be accepted or processed and the full amount owed under the RTO may be charged to your method of payment.

8. Money Back Guarantee

SSA offers a thirty (30) day money-back guarantee on the initial down payment for any products purchased under the RTO program. Where Customer is unsatisfied with the product or wishes to cancel their participation within the RTO program, Customer may do so by requesting a refund within thirty (30) days from the date of the initial down payment. Where any refund request is received within the guarantee window and complies with all other portions of this Policy, SSA will issue a full refund of the initial payment amount upon receipt of the returned product. Refund requests must be submitted through SSA Support. This guarantee applies only to the initial down payment and does not cover any subsequent payments made under the RTO Program. Please be aware that any refunds under this section may take up to three billing cycles to appear on Customer’s method of payment.

9. Policy Updates

SSA reserves the right to modify, update, or amend the terms of the RTO program, including but not limited to payment terms, return policies, and eligibility requirements, at its sole discretion. Any changes will be effective upon posting to SSA's official website or upon direct notification to the Customer. Continued participation in the RTO program after such changes constitutes acceptance of the updated terms. It is Customer’s responsibility to review the policy periodically for any updates. Customer may not assign any portion of this Policy to another party.

10. Collection of Unpaid Fees

You agree that if you breach the Policy, fail to make payments as required under the RTO program, fail to return any products that have not been fully purchased, or participate in a chargeback or fraudulent refund, we reserve the right to pursue our claims against you to the fullest extent permitted. This may include providing your information to law enforcement or civil authorities; or pursuing legal or collection actions. You agree that you will bear all costs and fees incurred by us under this section including but not limited to late fees, interest, and attorney and/or collection fees.

11. Disputes

Any disputes arising under or in connection with the Policy shall be brought exclusively in the state or federal courts located in Los Angeles, California. The parties agree that such disputes shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Additionally, the parties waive any right to bring or participate in a class action, either as a class representative or class member, in connection with any dispute arising from this agreement. All claims must be brought on an individual basis.
